This privacy policy (“Privacy Policy”) and the Hopin privacy policy (available at https://hopin.com/legal/privacy) governs how we, Boomset, Inc. (“Boomset”, “we”, “our" or “us”), use Personal Information (as defined below) that we collect, receive, process and store about event attendees and our Customers in connection with the use of: (i) the Boomset event management software platform and related services (“Boomset Platform and Services”), (ii) the website http://www.boomset.com/ , and any other website that we operate (each, together with its sub-domains, content and services, a “Site”); and (iii) the Boomset web and mobile software application, and any other software application, that we license (each individually, and collectively, the “Software”). The Boomset Services, the Sites, and the Software are individually and collectively referred to herein as the “Services”.

We have implemented this Privacy Policy because privacy is important to us. This Privacy Policy explains our online information practices and the choices our Customers can make about the way personal information is collected and used in connection with the Services.

Where other language versions of this Boomset Privacy Policy exist, the English version will prevail in the event of any conflict and/or confusion between the documents.

Information We Collect

While using our Services, we may ask you to provide us with certain Personal Information that can be used to contact or identify you. Personal Information may include, but is not limited to, your email address, name, phone number, postal address, and other information. Generally, since you are using our services as part of an event you are organizing, the information you enter should be your business contact information, not your personal contact information. Nevertheless, because we value your privacy, we still treat this data carefully and safeguard it from unintended disclosure or access.

Log Data

We collect information that your browser sends whenever you use our Services ("Log Data"). This Log Data may include information such as your computer's Internet Protocol ("IP") address, browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, and other statistics.

In addition, we may use third party services that collect, monitor, and analyze this type of information in order to increase the functionality of our Services and to improve your user experience. These third-party service providers have their own privacy policies addressing how they use such information. 

When you access the Services by or through a mobile device, we may collect certain information automatically, including, but not limited to, the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browser you use, your location information, and other statistics.

Cookies

Cookies are files with a small amount of data, which may include a unique identifier. Cookies are sent to your browser from a web site and transferred to your device. We use cookies to collect information in order to improve the delivery of our Services to you.

You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. The “Help” feature on most browsers provides information on how to accept cookies, disable cookies, or to notify you when receiving a new cookie.

Advertising

Boomset uses services to advertise on third party web sites to you after you visit our Services. We, and our third-party vendors, use cookies to inform, optimize and serve ads based on your past visits to our Services. The following lists the services we use:

Google

Google AdWords service is provided by Google Inc.

You can opt-out of Google Analytics for Display Advertising and customize the Google Display Network ads by visiting the Google Ads Settings page.

Google also recommends installing the Google Analytics Opt-out Browser Add-on for your web browser. Google Analytics Opt-out Browser Add-on provides visitors with the ability to prevent their data from being collected and used by Google Analytics.

Do Not Track Disclosure

We do not support Do Not Track ("DNT"). Do Not Track is a preference you can set in your web browser to inform websites that you do not want to be tracked.

You can enable or disable Do Not Track by visiting the Preferences or Settings page of your web browser.

How We Use and Share Your Information

We may use Personal Information, Log Data, and information collected from Cookies (collectively, the “Information”) for the purpose of providing the Services, identifying and communicating with you, responding to your requests/inquiries, servicing your purchase orders, informing you about our Services and new offerings, and soliciting your feedback and improving our Services. We may share such Information with our group companies, such as Hopin Limited and Hopin Ireland, and affiliates.

Service Providers

We may employ third party companies and individuals to facilitate our Services, to provide the Services on our behalf, to perform services related to the Services and/or to assist us in analyzing how our Services are used. For instance, we use a PCI compliant credit card company for processing credit cards and we host our Services on Amazon Web Services. We work hard to make sure that these parties are at least as careful with your Personal Information as we are.

These third parties have access to your Personal Information only to perform specific tasks on our behalf and are obligated not to disclose or use your information for any other purpose.

Communications

We may use your Personal Information to contact you with newsletters, marketing, or promotional materials and other information that may be of interest to you. You may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send or by contacting us.

Data That Does Not Identify You

In an ongoing effort to better understand our users and our Services, we may analyze information in aggregate form in order to operate, maintain, manage, and improve the Services. This aggregate information does not identify you personally. We may share this aggregate data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics in order to describe our products and services to current and prospective business partners and to other third parties for other lawful purposes.

When you use our Services, we collect statistical information about the usage of a group and/or an event in an anonymized form. This information does not identify you personally. We may share this information with you as well as with our affiliates, agents, Customers, and business partners.

Compliance With Laws - We will disclose your Personal Information where required to do so by law or subpoena or if we believe that such action is necessary to comply with the law and the reasonable requests of law enforcement or to protect the security or integrity of our Services.

Merger, Sale or Bankruptcy - In the event that we are acquired by or merged with a third-party entity, or in the event of bankruptcy or a comparable event, we reserve the right to transfer or disclose Personal Information in connection with the foregoing events.

Under EU/UK law our legal basis for processing your Personal Information is as follows:

  • our legitimate interests which are not overridden by your data protection interests or fundamental rights and freedoms, particularly taking into consideration the safeguards that we put in place
  • where we have your consent to do so. Where we have requested your consent to process your Personal information, you have the right to withdraw your consent at any time.
  • To protect your vital interests or those of another person.

Security

The security of your Personal Information is important to us, and we strive to implement and maintain reasonable, commercially acceptable security procedures and practices appropriate to the nature of the information we store, in order to protect it from unauthorized access, destruction, use, modification, or disclosure.

However, please be aware that no method of transmission over the internet, or method of electronic storage is 100% secure and we are unable to guarantee the absolute security of the Personal Information we may have collected from you. In particular, e-mail sent to or from the Services may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail and not send us any event attendee information by unsecure email.

Retention

Personal Information will be stored in accordance with applicable laws and retained as long as is necessary to carry out the purposes for which it was originally collected or otherwise required by applicable law.

International Transfer

Your information, including Personal Information, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

If you choose to provide information to us, please note that we may transfer the information, including Personal Information, to another country for processing. Generally, this will be either to the United States or to Turkey.

Where required, we rely on mechanisms such as the European Commission Standard Contractual Clauses to govern the transfer of Personal Information.

Your legal rights

You may have rights under certain data protection laws in relation to your Personal Information such as the following:

  • Request access to your Personal Information (commonly known as a “subject access request”). This enables you to receive a copy of the Personal Information we hold about you and certain information to check that we are lawfully processing it.
  • Request correction of the Personal Information that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.
  • Request erasure of your Personal Information. This enables you to ask us to delete or remove Personal Information where there are valid grounds for doing so and subject to applicable law.
  • Request restriction of processing of your Personal Information. This enables you to ask us to suspend the processing of your Personal Information in the following scenarios:
  • If you want us to establish the information’s accuracy.
  • Where our use of the information is unlawful but you do not want us to erase it.
  • Where you need us to hold the information even if we no longer require it as you need it to establish, exercise or defend legal claims.
  • You have objected to our use of your information but we need to verify whether we have overriding legitimate grounds to use it.
  • Right to data portability. You may have the right to receive certain of your information in a structured, commonly used and machine-readable format and to transmit such information to another controller.
  • Object to processing of your Personal Information where we process your data based on legitimate interest.  We will assess your objection and determine whether we have any compelling legitimate grounds or legal justification for continued processing.  
  • Withdraw consent at any time where we are relying on consent to process your Personal Information. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent.
  • Right to complain. You have the right to complain to a local data protection authority.

Children's Privacy

Our Services are only intended for persons age 18 or older and only person at least 18 years of age have permission to access our Services. Our Services are not directed to anyone under the age of 16 (“Child” or "Children").

We do not knowingly collect information from individuals under the age of 16. If you are a parent or guardian and you learn that your Child has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from a Child without verification of parental consent, we will promptly take steps to remove that information from our servers.

Changes to this Privacy Policy

This Privacy Policy is effective as of the date stated at the top.

California Supplemental Privacy Notice

We do not “sell” the personal information of our organizers or users as the term “sale” or “sell” is defined in the California Consumer Protection Act (“CCPA”). That mean means we do not sell, rent, or otherwise disclose your personal information in exchange for money or something else of value.

In addition to the rights described in this Privacy Policy, California law grants California residents certain rights as set forth below:

  • Notice. You have a right to be provided with a notice at minimum of the categories of Personal Information collected and the purposes for which it is used at or before the points of collection.  
  • Right to non-discrimination. The CCPA prohibits discrimination against California residents for exercising their rights under the CCPA, such as by denying or providing a different level or quality of goods or services, or charging different prices or imposing penalties on residents who exercise their CCPA rights, unless doing so is reasonably related to the value provided to the business by the residents’ data.

Requests to exercise your rights may be submitted by emailing us at privacy@hopin.to.  Please be prepared to provide your first and last name and email address that matches information we currently have on file.  Where we are unable to verify your identity based upon this information alone, we may require additional details. We will respond to verifiable requests received from California consumers as required by law.

Updates

We may amend or update this Privacy Policy from time to time.  The Last Updated date at the top of policy reflects the date of such policy changes.
